30 day Money-Back Guarantee (does not apply to software-only purchases)

If for any reason you are unsatisfied with your purchase of an MQGPS-TraQr, Quantum, Quantum Dot, or VeQtr system, you may return it for refund subject to the following conditions:

• You must request an RMA number via Info@MaxQData.com within 30 calendar days of the original shipping date.
• The returned equipment must be received complete, in new condition, with all original packaging and documentation, within 10 calendar days of the issuance of the RMA number.
• A restocking fee of 15% will be deducted from the refund amount.
• This money-back guarantee does not apply to software customization charges or to software-only purchases.  Hardware that is customized beyond standard options is non-returnable.  Non-stocked or special order products are non-returnable.
• This money-back guarantee applies only to cash equivalent purchases (cash, check, PayPal, credit card).  Limit 1 returned system per customer.  Different guarantees may apply to purchases made by purchase order or on "Net XX days" credit terms as spelled out in the purchase terms.
• This money-back guarantee does not apply to DIY unlock codes or software-only licenses.

1 year Limited Warranty

This Limited Warranty covers only to the following Hardware Components: MQGPS-5Hz, MQGPS-TraQr, Quantum, Quantum Dot.  Other components, such as Pocket PCs, netbooks, cameras, and accessories are not covered by this Limited Warranty but may be covered by their own manufacturer's warranty (contact MaxQData for details).

For a period of 1 year from the date of purchase, MaxQData will repair or replace any covered Hardware Component if there is a defect in materials or workmanship relating to functional electronics only.  There is no warranty on fitness for particular purpose, and no warranty on software.  All software is licensed "as-is".

This Limited Warranty does not cover:

• Mechanical damage
• Cosmetic damage
• Damage due to dirt, water, chemical contamination, corrosion, etc.
• Damage due to improper wiring or improper voltages
• Heat damage
• Racing damage
• Failure of the product due to misuse, abuse, or use beyond design intent
• Damage to the product caused by accident, fire, flood, or acts of God
• Incidental or consequential damage caused by defects in the Hardware Component(s), or any other incidental or consequential damages
• OBD-II incompatibility

In all cases, liability will be limited to repair or replacement, at the discretion of MaxQData, LLC, of the defective Hardware Component.  In no event shall MaxQData be liable for incidental, consequential or punitive damages resulting from any such cause.  This warranty is extended to the original purchaser only.  Purchaser pays one-way shipping charges in the United States and Canada, two-way elsewhere.  Purchaser must pay all duties, taxes, and insurance.  Warranty service is conditional upon proof of purchase and formal request of a warranty RMA number within the 1 year time period.  To request warranty service, contact Info@MaxQData.com within 1 year of the original purchase date to receive an RMA number.

Some states do not allow the exclusion or limitation of incidental or consequential damages.  This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.  To know what your legal rights are, consult your local or state consumer affairs office or your state's Attorney General.

Non-warranty service may be arranged by contacting Info@MaxQData.com.  Services and fees will depend on circumstances.

Hardware systems you purchase from MaxQData may include both new and previously used components.

Special Notes on Netbook, PDA, Smartphone, and Camera Warranties

MaxQData provides no warranty on the netbooks, PDAs, Smartphones, or cameras it sells.  These items typically do come with a manufacturer's warranty.  MaxQData is an Authorized Reseller of Acer products.  For warranty service on Acer-branded products, please contact Acer.  MaxQData is not an authorized reseller of other brands - we simply purchase them from authorized resellers on your behalf.  This may or may not affect your warranty rights at the discretion of the manufacturer.  Please contact the manufacturer for warranty details.

Special Note for iPhone and iPod Touch Users

Software for iPhone and iPod Touch is available solely through the Apple App Store.  Apple has sole control over the App Store, and it retains the right to exclude any software from the App Store.  It also retains the right to remotely disable software running on any iPhone or iPod Touch.  We don't anticipate any problems, but ultimately Apple's policies and procedures are outside of MaxQData's control.  Should Apple for any reason exclude the software you need for your MaxQData Hardware Component from the App Store, or remotely disable such software, you will not be eligible for a refund from MaxQData, unless you request it within the standard 30 day Money-Back Guarantee period.  You can, of course, continue to use your MaxQData hardware product standalone or with a compatible Windows Netbook or Windows Mobile PDA/Smartphone.
